    A lawsuit against EA Sports by former UCLA basketball star Ed O'Bannon was dismissed in a U.S. District Court in California on Wednesday. The case was centered on the accusation that EA Sports, NCAA and Collegiate Licensing Company used O'Bannon's likeness and image without his consent. Initially filed by O'Bannon in 2009, the suit grew legs as other professional or former professional athletes hopped on in a class-action suit, including Oscar Robertson.

    "This purported conspiracy involves Defendants' concerted action to require all current student-athletes to sign forms each year that purport to require each of them to relinquish all rights in perpetuity for use of their images, likenesses and/or names and to deny compensation 'through restrictions in the NCAA Bylaw," said Judge Claudia Wilken. "The Consolidated Amended Complaint, however, does not contain any allegations to suggest that EA agreed to participate in this conspiracy."

    This is a blow to college athletes who didn't want to be exploited. What the judge seems to say is that the players should sue the NCAA, not EA Sports. It is the NCAA that forced the players to sign away all their rights to market their images. EA Sports benefited from this arrangement, but they didn't create the situation.

    Sometimes I think the NCAA ought to be restructured or at least tweaked a little.
